However, The Children's Society cannot be held responsible for any omission, inaccuracy or error in fact and cannot be held liable for any outcome relating to a service, information or product so featured.

Our database and Disability Toolkit website contain external links to provide users with information and resources. However, The Children's Society cannot guarantee the quality or accuracy of the information on the sites linked to. Moreover, The Children's Society does not endorse any external sites and is not responsible for their content.

The Children's Society accepts no responsibility for information contained on this website and disclaims all liability in respect of such information.

In no event shall The Children's Society be liable for any damages whatsoever, and in particular The Children's Society shall not be liable for special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use, arising out of or related to The Children's Society's Disability Toolkit website or the information contained in it, whether such damages arise in contract, negligence, tort, under statute, in equity, at law or otherwise. Assignment, licence, warranties and indemnities

Except as set out below, The Children's Society owns the copyright and other intellectual property rights in this site, including its design, text, graphics and their arrangements and the underlying technology and executable code.

By contributing materials to the Disability Toolkit database (“the Database”), each individual contributor of such materials ("a Contributor"):

  1. so far as such Contributor is able assigns to The Children's Society the copyright and other intellectual property in such contribution. Insofar as such Contributor is not able to make such assignment, such Contributor grants to The Children's Society, any successor operator of the Database and any users of the Database a non-exclusive, irrevocable, perpetual, royalty free licence to use, copy, translate, alter, transfer or distribute the materials contributed to the Database by such Contributor for the purposes of education and activities with disabled children and young people provided that, where applicable, an acknowledgement is given to The Children's Society as the copyright holder and original publisher;
  2. warrants to The Children's Society and any successor operator of the Database that the materials contributed to the Database are the Contributor's own original work, have not been copied wholly or substantially from any other work or material and that the exercise of rights pursuant to the assignment or licence granted in paragraph 1 above will not infringe the rights of any third party;
  3. further warrants to The Children's Society and any successor operator of the Database that the materials contributed contain nothing that is libellous, defamatory or indecent or which infringes the statutory or common law rights of any third party;
  4. agrees to permit The Children's Society and any successor operator of the Database, on the Contributor's behalf, to do any acts and things that The Children's Society or such successor may consider necessary to give effect to the assignment and/or the licence granted under paragraph 1 above; and
  5. waives the Contributor's rights (if any) to be identified as the author of the contributed materials and to object to derogatory treatment of such materials.

Contributors are legally responsible for what they write. For example, Contributors must not make statements that are libellous or obscene, seek to incite racial hatred or otherwise break the laws of the United Kingdom or elsewhere.

By contributing materials to the Database, each Contributor undertakes to indemnify The Children's Society, any successor operator of the Database and their employees, agents and subcontractors against all liability, actions, claims, demands, costs (including without limitation all expenses incurred in conducting or defending any proceedings) or damage arising directly or indirectly:

  1. as a result of any breach of the warranties in paragraphs 2 and 3 above;
  2. as a result of any breach of confidentiality or data protection laws resulting from materials contributed by such Contributor to the Database; or
  3. otherwise resulting from materials contributed to the Database by such Contributor.

It is the responsibility of the users of materials or activities on the Database to carry out a proper risk assessment for each activity which uses materials contributed to the Database. It is not the responsibility of The Children's Society or any successor operator of the Database to carry out any such risk assessment and the safety of such materials or activities is not guaranteed.

Linking to The Children's Society's Disability Toolkit website

You do not need to request permission to create a text link from your site to The Children's Society's Disability Toolkit website. You must not make use of The Children's Society logo without permission. The logo should never be taken as a screen grab from our site and should never be part-masked in usage.
